MN Call to Action – Template for Contacting MN Reps

As you probably heard, the Minnesota Court of Appeals issued a ruling in a case called Minnesota v. Loveless. The court said the state legislature failed to amend Minnesota’s criminal law for possessing a liquid with less than .3% delta-9 THC when it changed the law to exclude hemp plant. This means CBD/CBN containing ANY THC (oils, vapes, balms, drinks, etc.) are still a Schedule I narcotic and illegal.  

This has also prompted a Sheriff to enter a CBD Store in Park Rapids stating that they had five days to rid of all products containing any THC or they’ll be arrested.

 The Loveless is still being appealed but the Minnesota legislature needs to hear from people who are affected by this issue. We need a full court press to get this issue resolved. Below is a template of an email you can send to your state representative. You can search for State House Representative and State Senator contact info with your address here.  Feel free to add language if you are a business owner who sells these products or if you are consumer of them. Personal details help get the point across. The more our representatives hear about the issue, the more they’ll see the urgency of the issue.

I live at (*insert address to prove you are a constituent*), and I’m writing about the recent Court of Appeal case Minnesota v. Loveless. The court found an error in Minnesota’s controlled-substance laws about hemp liquids. When the Legislature created the hemp program, it did not change the definition of Schedule I narcotic in Minnesota Statute 152.02, sud. 2(h)(2) to exclude liquids and products with less than .3% delta-9 THC, unlike the definition of marijuana plants. This means buying and selling products such as CBD liquids, oils, vapes, creams, etc. is illegal under Minnesota’s criminal laws because they’re controlled substances.

This was not what the Legislature intended. I’m bringing this to your attention so it can be fixed as soon as possible. People who buy these products and businesses who sell them are at risk of criminal charges until the loophole in this case is fixed. Thank you for your time addressing this important issue.
